Terms of Service

1. Scope and Service

These Terms of Service govern the use of the Discord bot „Nexus“ (hereinafter „Bot“), operated by Andreas Lindner (hereinafter „Provider“), accessible via trynexus.de.

By inviting the Bot to a Discord server („Guild“) as an administrator or server owner, or by interacting with the Bot as an end user, you agree to these Terms.

2. Bot usage and Leveling System

  • Leveling and Activity System: The Bot provides a server-based leveling and engagement system (experience points/XP, ranks, automated role assignments). These features are designed solely for entertainment and tracking community engagement.

  • No Monetary Value & No Claim: Experience points, levels, and ranks hold no monetary, commercial, or material value. Users have no legal claim to the retention, recovery, or permanent availability of leveling stats (e.g., following database resets, maintenance, or data loss).

  • Prohibited Abuse & Trading: Artificially altering levels (via self-bots, spam, or exploits) and selling, purchasing, or trading levels, XP, or perks for real-world currency is strictly prohibited. Violations may result in blacklisting users or entire servers.

3. Nexus Premium and Payment Processing (Merchant of Record)

  • Subscriptions & Processing: Enhanced features („Nexus Premium“) are provided as recurring monthly subscriptions per server through Discord’s official in-app purchasing system (App Subscriptions).

  • Merchant of Record: The sole contractual partner for purchases and payment processing is Discord (Discord Netherlands B.V. or Discord Inc.) acting as Merchant of Record. The Provider does not collect, process, or store any payment details and does not issue invoices.

  • Cancellation: Subscriptions can be canceled at any time within your Discord settings under „Subscriptions“. Premium features remain active until the end of the current billing cycle.

  • Refunds: Refunds are strictly governed by Discord’s Refund Policy. Inquiries must typically be submitted to Discord Support within 5 days of purchase. The Provider is technically unable to process refunds.

  • Expiration & Data Retention: When a Premium subscription ends, free tier limits reapply immediately. Excess configurations (e.g., additional embeds, custom messages) remain stored in our database but become inactive until Premium is renewed.

  • Modifications: Features and tier limits may be updated, modified, or discontinued as the project evolves.

4. Disclaimer of Warranties (“As is”)

  • The Bot is provided on an „as is“ and „best-effort“ basis without warranty of uninterrupted availability, absence of errors, or guaranteed response times.

  • No warranty is made regarding downtime or delivery delays caused by third-party platform APIs (including Discord, Twitch, YouTube, or Kick).

  • Automated moderation, notification, and security features (such as anti-nuke or raid protection) serve as administrative aids. We cannot guarantee complete prevention or detection of malicious server activity.

5. Limitation of Liability

The Provider is liable for damages exclusively in cases of intent or gross negligence. For slight negligence, liability is limited to breaches of essential contractual obligations (cardinal duties) and damages resulting from injury to life, body, or health. Liability for breaches of essential obligations is capped at foreseeable, typical contract damage.

6. Violations of Guidelines and Policies

Using Nexus requires adherence to Discord’s Terms of Service and Community Guidelines. In the event of guideline breaches, abusive usage, or activities harmful to the service, the Provider reserves the right to immediately remove the Bot and ban responsible servers or user accounts.

7. Final Provisions

  • These terms are governed by the laws of the Federal Republic of Germany.

  • Should any provision of these Terms be held invalid or unenforceable, the validity of the remaining provisions remains intact.
