Terms of Service | Nexus Bot

1. Scope and Service

These Terms of Service govern the use of the Discord bot “Nexus” (hereinafter referred to as the “Bot”), accessible via the website trynexus.de. The Bot is provided by Andreas Lindner (hereinafter referred to as the “Provider”).

By adding the Bot to a Discord server (“Guild”) as an administrator, or by interacting with the Bot on a daily basis as an end user, you agree to these Terms in their entirety.

2. Use of the Bot and Virtual Systems (Nexus Coins)

The Bot provides users with a gamified system in the form of virtual points (“Nexus Coins”) and levels.

Exclusion of Real-World Value: Nexus Coins are purely cosmetic in-game points within the Bot. They possess no real-world monetary value, cannot be purchased or sold, and cannot at any time be exchanged for real currency, cryptocurrencies, or tangible goods.

Trading, selling, or transferring Nexus Coins or virtual levels for real money, or outside of the functionalities intended by the Bot, is strictly prohibited and will result in a permanent ban of the user and, if applicable, the entire Discord server from using Nexus.

3. Payments and Premium Subscriptions (Merchant of Record)

The provision of enhanced features (“Nexus Premium”) is handled exclusively through the official in-app monetization system (App Subscriptions) in the Discord Store.

Contractual Partner: The contractual partner for subscription purchases and payment processing is exclusively the Discord platform (Discord Netherlands B.V. or Discord Inc.) acting as the Merchant of Record. The Provider of Nexus itself does not process payment data, issue invoices, or handle statutory withdrawals/refunds.

Cancellations, refund requests, or any other inquiries regarding your subscription agreement must be handled directly through Discord’s designated interfaces and under Discord’s terms.

4. Disclaimer of Warranties and Availability (“As is”)

The Bot, particularly the free base version, is provided without any claim to continuous, uninterrupted availability, error-free operation, or specific uptime (operation is on a “best-effort” basis).

The software is provided “as is”. Any warranty for the loss of configurations, levels, moderation logs, or server data is excluded to the maximum extent permitted by law.

5. Limitation of Liability

The Provider shall only be liable for damages resulting from the use of the Bot in cases of intent or gross negligence. Liability for slight negligence is excluded, unless it involves a breach of material contractual obligations (cardinal duties) or damages resulting from injury to life, limb, or health.

6. Violations of Guidelines and Policies

The use of Nexus requires that both server administrators and end users comply with Discord’s official Terms of Service as well as Discord’s Community Guidelines. If a server or its operators violate these guidelines, or use the Bot for abusive, illegal, or harmful activities, the Provider reserves the right to immediately remove the Bot from said server and permanently terminate service for that server without prior notice.

7. Final Provisions

The laws of the Federal Republic of Germany shall apply.
Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected (severability clause).
